Lydian & ACC Lunch Webinar: "Recent developments in distribution channels in an international market" - 13 October 2022

In a fast-paced and ever-changing competitive environment, companies today heavily rely on commercial agents and distributors around the world to distribute their products to end users. This creates legal challenges, for example, for companies that have acquired businesses with an existing extensive network of commercial agents and distributors in several European countries, including Belgium. This is especially challenging for in-house counsels who must anticipate and manage the common legal consequences and pitfalls in this regard.

This webinar organized by Lydian in collaboration with the Association of Corporate Counsel (ACC) is therefore designed to provide in-house counsels and compliance officers with the necessary guidance to identify, analyse and mitigate the legal risks of commercial agency and distribution agreements. This will be done by using an interactive format with the aim of establishing an open dialogue with the audience.

The main discussion points will be:

  • Highlighting the legal differences between commercial agency and distribution agreements.
  • Addressing the latest case law of the European Court of Justice on commercial agency and anticipating its potential impact on existing commercial agency agreements in Belgium and Europe.
  • Examining the legal framework in Belgium on the termination of distribution agreements compared to other European countries.
  • Studying the impact of the revised EU Vertical Block Exemption Regulation on the drafting and interpretation of distribution agreements.
