Fact sheets – dispute resolution methods, arbitration & mediation
Today, at the occasion of the Conflict Resolution Day, our Dispute Resolution Team releases two other fact sheets about Dispute Resolution Methods and Arbitration in Belgium. Given the growing interest for alternative forms of dispute resolution from our clients and the legislator/courts and as best independent Belgian law firm in Litigation & Arbitration in 2018 according to the Trends Legal Award, we consider it important to provide you with the main characteristics of these methods.
In parallel we are conducting a survey “Dispute management by companies” in collaboration with IBJ/IJE and will keep you posted of the results within the coming weeks.

- Which method of dispute resolution to choose for your dispute? (Publication #1)
As lawyers we like defending our clients before Courts or a panel of arbitrators.
However, we are aware that these methods of dispute resolution are not always the most appropriate and efficient, at least not in first instance. We therefore advise our clients to consider negotiations and mediate if possible.
In order to help you choose the most appropriate method, we provide you with a schematic comparison of these methods (advantages and disadvantages) in our fact sheet, after a brief description of the four methods of dispute resolution.
- Arbitration (Publication #2)
Arbitration presents fundamental differences with judicial proceedings. Our fact sheet arbitration provides an answer to the following questions: How is it regulated, what are its advantages and possible difficulties? What are the costs?
- Mediation (Publication #3)
Mediation is strongly encouraged by the Belgian legislator and the courts. You will find in our fact sheet an overview of the types of mediations and characteristics of this alternative method of dispute resolution.
