Webinar "Use of others’ IP rights : some takeaways from the recent case law" - 8 December 2020

When starting or doing business off or online, many IP issues  may raise and notably regarding (prior) IP rights of third parties including competitors.

During this webinar, Lydian’s IP team will tackle some of these issues addressed in the recent case law of the European Court of Justice, the EUIPO as well as some Belgian or foreign courts. 

Lydian’s IP team will notably discuss the following questions :

  • Use of patronymic names : to what extent can I do business under my own family name although this family name is already registered as a trademark by someone else? 
  • Use of Google AdWords :  Can I purchase a competitor AdWord to promote / rank better my  own business on the Internet?
  • Use of hyperlinks : Can I reproduce an article from a newspaper on my company website by using an hyperlink?
  • Use of a trademark: trademark rights look magic since they may offer a perpetual monopoly on a sign. This implies however a genuine use of that sign as a trademark. How to be well prepared to prove that use in case of counterclaim or cancellation action?
