Lydian / ACC Europe webinar on contractual risk assessment: results of the poll
On a daily basis, legal counsels are dealing with the overall contractual risk assessment when analyzing (existing or projected) agreements and their content. This requires careful consideration and awareness of various issues in a broad range of legal fields.
Therefore, Lydian and the Association of Corporate Counsel Europe (ACC Europe) organized a webinar on contractual risk assessment on 22 September 2020. During this seminar, we tackled issues from a corporate, commercial, real estate and IP/IT point of view and provided useful tips and tricks to more than 250 participants.
We also took this opportunity to launch a poll among the participants in order to obtain some useful insights. We learned via a poll that (i) most of the companies limit their liability by excluding certain types of damage or by providing for a maximum amount; (ii) that copyright (including software) and trademark rights are considered to be the most valuable intellectual property rights; and (iii) that a majority expects that earn-out clauses will be more often used during the Covid-19 pandemic.
