New Chambers Global Practice Guide | Insurance Litigation 2026

What are the key developments shaping insurance litigation in Belgium?

Belgian courts are increasingly siding with policyholders when policy wording leaves room for interpretation. This is one of the trends highlighted by our Insurance team in Lydian’s Belgian contribution to the latest Chambers Insurance Litigation 2026 Global Practice Guide.

A few other developments worth knowing about:

🔹 Since October 2024, insurers have three months to respond to a claim, with penalties if they miss the deadline. For complex industrial losses, questions remain as to when that period actually starts.

🔹 Belgium’s new rules on non-contractual liability, in force since 2025, make it easier to bring claims against both companies and their directors, with important implications for financial lines.

🔹 AI is increasingly affecting both sides of the claims process: insurers are using it to detect fraud, while fraudsters are using it to create increasingly convincing fake photos and invoices.

The Belgian chapter was written by Hugo Keulers, Sandra Lodewijckx, Tine Meurs and Thomas Verheyen and provides insights into key topics ranging from insurance disputes and coverage to arbitration, jurisdiction and choice of law.
